1. Introduction

Welcome to the OnDemand Website. These Customer Terms and Conditions ("Terms") govern your use of the App and the services provided. By accessing, downloading, or using the App, you agree to comply with these Terms. If you do not agree, please discontinue use of the App.

2. Eligibility

• The App is strictly for individuals aged 21 years or older. By using the App, you confirm that you are above the age of 21. This confirmation must also be agreed to in Sinhala, Tamil, and English.
• Registration requires submission of a valid National Identity Card (NIC), including an image of the NIC, to verify your age and identity. This measure is implemented in compliance with the National Authority on Tobacco and Alcohol Act No. 27 of 2006, which prohibits the sale of tobacco products to individuals under the age of 21 in Sri Lanka. The NIC image is necessary to reconfirm the customer's age and ensure compliance with the law.
• The App is available for download and usage in Sinhala, Tamil, and English, with descriptions and functionality provided in all three languages.

3. Disclaimer

• A static disclaimer, prominently displayed in Sinhala, Tamil, and English, will appear on the App. This disclaimer reiterates that the App is solely for individuals aged 21 years or older and prohibits sales to minors.

4. User Accounts

• To access the services of the App, users must register and create an account. Registration requires the provision of accurate and truthful information, including the upload of your NIC image.
• Users are responsible for maintaining the confidentiality of their account credentials and for all activities under their account.
• The App reserves the right to suspend or terminate accounts found to be in violation of these Terms.

5. Use of the App

• Users agree to use the App only for lawful purposes and in compliance with all applicable laws in Sri Lanka, including the Electronic Transactions Act No. 19 of 2006 and the Consumer Affairs Authority Act No. 9 of 2003.
• Any misuse, fraudulent activity, or attempt to circumvent age verification measures will result in account termination and potential legal action.

6. Age Verification and Purchase Conditions

• By purchasing through the App, you confirm that you are above the age of 21. This confirmation will be required during the checkout process in Sinhala, Tamil, and English.
• Users must ensure their account details, including NIC information, are accurate. The App may request re-verification of age at any time.
• The App strictly prohibits sales or deliveries to individuals under the age of 21. If fraud is suspected, delivery may be refused, and the relevant authorities may be notified.

7. App Availability and Features

• The App is made available for download on Google Play Store with descriptions in Sinhala, Tamil, and English. The description will state: "This app is only for individuals over the age of 21, and the app will not sell to anyone below the age of 21."
• The App's interface, features, and disclaimers will also be accessible in Sinhala, Tamil, and English.

8. Privacy Policy

• The App collects and processes personal data, including NIC images, in accordance with the Personal Data Protection Act No. 9 of 2022 of Sri Lanka. For detailed information on how your data is handled, please refer to the App's Privacy Policy.

9. Limitation of Liability

• The App and its operators are not liable for any misuse of the App by users, including providing false information during registration.
• While the App implements robust measures to ensure age verification, users are ultimately responsible for ensuring compliance with these Terms.

10. Intellectual Property

• All intellectual property related to the App, including its content, design, and branding, is owned by the App's operators and protected under the Intellectual Property Act No. 36 of 2003.

11. Changes to Terms and Conditions

• The App reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the App constitutes acceptance of the updated Terms.

12. Governing Law

• These Terms are governed by the laws of Sri Lanka. Any disputes arising from these Terms or the use of the App will be subject to the exclusive jurisdiction of Sri Lankan courts.
